Process of Property Transfer in India: A Simple Step-by-Step Guide

Step 2: Payment of Stamp Duty and Registration Charges

 

Stamp duty and registration fees must be paid to the government as per applicable state laws. These charges vary depending on the property’s value, location, and type of transfer. Payment of stamp duty is compulsory, as a document without proper stamp duty has no legal validity.

Step 3: Signing of the Transfer Deed

After completing the payment of government charges, the transfer deed is signed by both the current owner (transferor) and the new owner (transferee). The signing must take place in the presence of two witnesses, whose signatures are also required to validate the document.

Step 4: Registration at the Sub-Registrar Office

The signed deed must be registered at the local Sub-Registrar Office. Registration officially records the transaction in government records and gives the document legal recognition. Without registration, the ownership transfer is not legally accepted, even if stamp duty has been paid.

Step 5: Mutation of Property Records

After registration, mutation is carried out to update the new owner’s name in municipal or revenue records. Mutation ensures that property tax bills and local government records reflect the correct ownership, which is important for future transactions and legal clarity.

The property transfer process usually requires documents such as the previous title deed, identity and address proof of both parties, property tax payment receipts, and a no-objection certificate if applicable. In cases of inheritance or gift, additional documents like a will or legal heir certificate may also be required.
